For Advertisers:

1. All Ads are subject to the approval of Chinese Drywall Marketing (“CDM”). If your Ad is rejected, payment will be refunded within 24 hours. Once approved, your Ad will be posted within 24 hours.
2. All Ads run month to month. Prices subject to change.
3. CDM may reject or discontinue any Ad at any time and for any reason. In such event, CDM shall refund to Advertiser a pro rata portion of the fee paid for that month.
4. Limitation of Liability; Disclaimer; Indemnification. CDM does not make and specifically disclaims any representations or warranties, express or implied, and under no circumstances will CDM’s aggregate liability hereunder exceed the advertising fees actually paid by Advertiser.
5. Advertisers assume responsibility for all content. Neither CDM nor its officers, directors or affiliates shall have any liability whatsoever for any reason, including by reason of error in any advertisement beyond liability to give the Advertiser a credit for so much of the space occupied by the advertisement as is materially affected by the error; and its obligation to give such credit shall not apply unless it is notified of the inaccuracy within 48 hours following the posting error. CDM shall not be liable to the Advertiser for any technical malfunction, computer error or loss of data or other injury, damage or disruption to advertisements or any web sites. Advertiser agrees to indemnify and hold CDM, its officers, directors and affiliates harmless from and against all claims, actions, liabilities, losses, expenses, damages and costs (including, without limitation, reasonable attorney’s fees) arising under or relating to this Agreement.

 

For Contractors and Other Services :

1. Directory is not a referral service and no individual or entity listed in this Directory is an employees or agent of Chinese Drywall Marketing, LLC.
2. CDM may reject or discontinue any listing at any time and for any reason. In such event, CDM shall refund to Contractor a pro rata portion of the fee paid for that month.
3. Limitation of Liability; Disclaimer; Indemnification. CDM does not make and specifically disclaims any representations or warranties, express or implied, and under no circumstances will CDM’s aggregate liability hereunder exceed the fees actually paid by the Contractor.
4. Contractor assume responsibility for the accuracy of information uploaded to this directory.
5. Neither CDM nor its officers, directors or affiliates shall have any liability whatsoever for any reason whatsoever, including any technical malfunction, computer error or loss of data or other injury, damage or disruption to a listing or any web sites. Contractor agrees to indemnify and hold CDM, its officers, directors and affiliates harmless from and against all claims, actions, liabilities, losses, expenses, damages and costs (including, without limitation, reasonable attorney’s fees) arising under or relating to this Agreement.
